In short: Tapwise gives general information based on official water testing records. It is not medical advice, describes water suppliers rather than your individual tap, and is provided as is.
1. Who we are
These Terms govern your use of the Tapwise app (the “App”), published by AIR DISTRIBUTION LLC, 2105 Vista Oeste NW Ste E1254, Albuquerque, NM 87120-3693, United States (“we”, “us”). By using the App you agree to these Terms. If you download the App from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies.
2. What the App provides
The App summarizes publicly available water testing, violation and infrastructure records for the water supplier that serves an area, and presents them with our own grade and general guidance. The Tapwise grade is our own assessment, not a rating by any government agency. Tapwise is not affiliated with, endorsed by, or sponsored by any government agency or water supplier.
3. Not medical or professional advice
Information in the App is for general information only. It is not medical, health, legal or engineering advice. Talk to a doctor about health questions, and contact your water supplier about your water service. Always follow any notice issued by your water supplier or local authorities.
4. Limits of the information
Results describe a water supplier’s reported records, not the water from your individual tap, which can differ (for example, because of plumbing in your building). Records are collected on schedules set by regulators, may be incomplete, out of date or contain errors, and service areas may be estimated. Private wells are not covered. We do our best to present the information accurately but do not guarantee it.
5. Purchases
Some features, such as unlocking a full report, require a one-time purchase made through the Apple App Store or Google Play. Each purchase unlocks the report for the area shown at the time of purchase. Payments, refunds and billing are handled by the app store under its own terms.
6. Acceptable use
Do not misuse the App, including by copying, scraping or reselling its content, interfering with its operation, or using it for any unlawful purpose.
7. Intellectual property
The App, its design, grades and written content belong to AIR DISTRIBUTION LLC or its licensors. Third-party data and software included in the App are used under their own licenses, listed in the App under About & Legal.
8. Disclaimer
THE APP AND ALL INFORMATION IN IT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AIR DISTRIBUTION LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY DECISION MADE IN RELIANCE ON THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM.
10. Changes
We may update the App and these Terms. We will change the “Last updated” date above, and continued use of the App means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.
